Terms and Conditions of Sale

1. Introduction

These Terms and Conditions govern the sale of computers, laptops, mobile phones, tablets, accessories, software, peripherals, and related products by Mckins Technology Limited (“Company”, “we”, “us”, or “our”).

By placing an order, making a purchase, accepting delivery, or using products or services supplied by the Company, the customer (“Customer”, “you”, or “your”) agrees to these Terms and Conditions.

Please read these Terms carefully before completing a purchase.

2. Products and Product Information

We make reasonable efforts to ensure that product descriptions, images, specifications, prices, availability, and other information provided by us are accurate.

However:

  • Product images may differ slightly from the actual product.
  • Manufacturers may change specifications, packaging, colours, or accessories without prior notice.
  • Product specifications may vary according to model, region, configuration, or production batch.
  • Availability is subject to stock levels.
  • Minor differences between product images and the actual product do not necessarily constitute a defect.

Where there is a material difference between the product ordered and the product supplied, the Customer may have rights under our Refund and Returns Policy and applicable law.

3. Prices

All prices are stated in Nigerian Naira (₦), unless otherwise specified.

Prices may be changed at any time before an order is confirmed. Once an order has been accepted and payment confirmed, the agreed price will generally apply, subject to correction of genuine pricing or administrative errors and applicable law.

Prices may or may not include:

  • Value Added Tax (VAT);
  • Delivery charges;
  • Installation or configuration fees;
  • Customs duties or other applicable charges; or
  • Optional services.

Any applicable additional charges will be communicated to the Customer before payment where reasonably practicable.

4. Orders

An order is considered accepted when the Company confirms the order and/or receives payment, subject to product availability and successful verification.

The Company reserves the right to:

  • Decline or cancel an order;
  • Limit quantities;
  • Request additional information to verify an order;
  • Correct genuine pricing or product-information errors; or
  • Cancel orders where a product is unavailable.

If an order is cancelled after payment has been received, any applicable refund will be processed in accordance with our Refund and Returns Policy and applicable law.

5. Payment

Payment must be made using an approved payment method provided by the Company.

Accepted payment methods may include:

  • Bank transfer;
  • Card payments;
  • POS payments;
  • Approved online payment platforms; and
  • Other payment methods authorised by the Company.

Products remain the property of the Company until full payment has been received, to the extent permitted by applicable law.

The Company may delay delivery or collection until payment has been successfully verified.

6. Corporate and Bulk Orders

For corporate, institutional, project, or bulk purchases, additional terms may apply.

These may include:

  • Written quotations;
  • Purchase orders;
  • Deposit requirements;
  • Credit arrangements;
  • Delivery schedules;
  • Installation or deployment requirements;
  • Extended warranty arrangements; and
  • Specific service-level agreements.

Where a separate written agreement has been signed, that agreement will take precedence over these general Terms and Conditions to the extent of any inconsistency.

7. Delivery

The Company will make reasonable efforts to deliver products within the estimated delivery period communicated to the Customer.

Delivery times may be affected by:

  • Product availability;
  • Customer location;
  • Courier or logistics delays;
  • Public holidays;
  • Weather or other circumstances beyond our reasonable control;
  • Incorrect customer information; or
  • Security or access restrictions.

Estimated delivery dates are not guaranteed unless expressly agreed in writing.

The Customer is responsible for providing accurate delivery information and ensuring that someone authorised is available to receive the order.

8. Inspection Upon Delivery

Customers are encouraged to inspect products and packaging upon delivery.

Where possible, Customers should confirm:

  • The product model;
  • Quantity;
  • Serial number or IMEI;
  • Physical condition;
  • Accessories supplied; and
  • Any visible signs of damage.

Any visible delivery damage or incorrect item should be reported promptly in accordance with our Refund and Returns Policy.

9. Risk in Products

Subject to applicable law, responsibility for the product passes to the Customer upon delivery or collection.

Customers are responsible for taking reasonable care of products after delivery, including protecting them from theft, accidental damage, liquid exposure, power surges, extreme conditions, and misuse.

10. Product Authenticity

The Company aims to supply genuine products sourced through legitimate distribution and supply channels.

Customers should retain their original invoice or receipt as proof of purchase.

Where applicable, product serial numbers, IMEI numbers, service tags, warranty cards, or other identifying information may be recorded for warranty, support, inventory, and security purposes.

11. Warranty

Products may be supplied with:

  • Manufacturer's warranty;
  • Distributor warranty;
  • Company warranty; or
  • No additional warranty where clearly disclosed before purchase.

Warranty periods and coverage vary by product and manufacturer.

Unless covered by applicable warranty terms or law, warranty service may not cover:

  • Accidental damage;
  • Physical damage;
  • Liquid or moisture damage;
  • Electrical or power-related damage;
  • Unauthorised repairs or modifications;
  • Misuse or negligence;
  • Normal wear and tear;
  • Consumable components;
  • Software issues caused by unauthorised applications or modifications; or
  • Damage caused by failure to follow manufacturer instructions.

The Company's Refund and Returns Policy also applies where relevant.

12. Returns, Refunds and Exchanges

Returns, refunds, replacements, and exchanges are governed by the Company's Refund and Returns Policy.

Customers should contact the Company before returning a product unless otherwise required by applicable law.

Returned products may be inspected to determine eligibility for a refund, replacement, repair, or exchange.

Nothing in these Terms limits any mandatory rights available to consumers under applicable law.

13. Computers and Software

The Customer acknowledges that computer performance depends on hardware configuration, operating system, drivers, software, workload, and other factors.

Unless expressly included in the purchase:

  • Software licences are not automatically included;
  • Installation and configuration services may attract additional charges;
  • Third-party software is subject to its own licence terms;
  • The Customer is responsible for maintaining valid software licences; and
  • The Customer is responsible for backing up important data.

The Company is not responsible for unauthorised software installations or software used in breach of applicable licences.

14. Mobile Phones and IMEI/Network Compatibility

Mobile phones may be subject to network, SIM, regional, carrier, or frequency-band compatibility requirements.

Customers are responsible for confirming that a device is compatible with their intended network and usage requirements where such information was reasonably available to them before purchase.

IMEI numbers and other device identifiers may be recorded for inventory, warranty, anti-fraud, and after-sales purposes.

Customers must not alter, remove, clone, manipulate, or interfere with a product's IMEI or other identifying information.

15. Accessories and Consumables

Accessories such as chargers, cables, batteries, keyboards, mice, headphones, cases, adapters, storage devices, and similar products may have separate warranty periods and conditions.

Consumable or wear-and-tear components may have limited warranty coverage where permitted by applicable law.

16. Installation and Configuration Services

Where the Company provides installation, setup, data-transfer, software installation, networking, or configuration services, the scope of work and applicable charges should be agreed before the service is performed.

Customers should maintain backups of important information before allowing any technician to modify or transfer data.

The Company will take reasonable care when performing technical services but cannot guarantee that every third-party software, hardware, network, or compatibility issue will be resolved.

17. Customer Data and Privacy

Customers are responsible for protecting and backing up their personal and business data.

Before returning or submitting a device for repair, exchange, or warranty service, Customers should:

  • Back up important files;
  • Remove personal accounts where possible;
  • Remove passwords and device locks where appropriate;
  • Remove SIM and memory cards; and
  • Sign out of relevant cloud services.

The Company will handle Customer information in accordance with applicable privacy and data-protection requirements.

18. Customer Responsibilities

Customers agree to:

  • Provide accurate contact, billing, and delivery information;
  • Pay all amounts due;
  • Use products in accordance with manufacturer instructions;
  • Maintain valid licences for licensed software;
  • Not modify products in ways that compromise safety or warranty coverage;
  • Not use products for unlawful purposes; and
  • Promptly notify the Company of material issues with an order.
19. Fraud Prevention

For security purposes, the Company may verify customer information and payment details before processing certain orders.

We reserve the right, subject to applicable law, to suspend or cancel transactions where there are reasonable grounds to suspect:

  • Fraud;
  • Stolen payment credentials;
  • Identity misuse;
  • Counterfeit products;
  • Manipulation of serial numbers or IMEI numbers;
  • Unauthorised resale; or
  • Other unlawful activity.
20. Limitation of Liability

To the extent permitted by applicable law, the Company will not be liable for indirect, incidental, special, or consequential losses arising from the purchase or use of a product.

This may include loss of:

  • Business opportunities;
  • Revenue;
  • Profits;
  • Data;
  • Software;
  • Productivity; or
  • Expected savings.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

21. Events Beyond Our Control

The Company will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including:

  • Natural disasters;
  • Fire or flooding;
  • Government actions;
  • Import or export restrictions;
  • Power or telecommunications failures;
  • Industrial disputes;
  • Security incidents;
  • Transport disruptions;
  • Epidemics or pandemics; or
  • Other extraordinary circumstances beyond reasonable control.

The Company will make reasonable efforts to minimise the impact of such events.

22. Intellectual Property

All trademarks, logos, product images, website content, marketing materials, graphics, documents, and other intellectual property belonging to the Company or third parties remain the property of their respective owners.

Customers may not reproduce, modify, distribute, or commercially exploit Company-owned materials without prior written permission.

Manufacturer trademarks belong to their respective owners.

23. Promotions and Discounts

Promotional offers, discounts, vouchers, and special pricing may be subject to additional conditions.

Unless expressly stated otherwise:

  • Promotions cannot be combined;
  • Promotional offers are subject to availability;
  • Discounts may apply only to specified products; and
  • Promotional offers may expire at the stated time.

The Company reserves the right to withdraw or correct an offer where a genuine pricing, technical, or administrative error has occurred, subject to applicable law.

24. Resale and Commercial Use

Customers purchasing products for resale, deployment, rental, or commercial distribution may be subject to separate terms.

Unauthorised representation as an official dealer, distributor, agent, or representative of the Company or a manufacturer is prohibited.

25. Complaints and Dispute Resolution

Customers should first contact the Company regarding any complaint or dispute.

We will make reasonable efforts to investigate complaints and reach a fair resolution.

Customers should provide relevant information, including invoices, order numbers, product identifiers, photographs, correspondence, and details of the issue.

Where a dispute cannot be resolved directly, either party may pursue any rights or remedies available under applicable law.

26. Governing Law

These Terms and Conditions shall be governed by the laws of the Federal Republic of Nigeria.

Any dispute arising from these Terms shall be subject to the jurisdiction of the competent courts of Lagos State, subject to any mandatory consumer-protection rights applicable to the Customer.

27. Amendments

The Company may update these Terms and Conditions from time to time.

The Terms applicable to a particular purchase will generally be those communicated or made available to the Customer at the time of purchase, subject to applicable law.

28. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

29. Entire Agreement

These Terms, together with the applicable quotation, invoice, order confirmation, warranty terms, Refund and Returns Policy, and any separately signed agreement, constitute the agreement between the Company and Customer regarding the relevant purchase.

Where there is a conflict between documents, a separately signed agreement will generally take precedence, followed by any specific written quotation or order terms, then these general Terms and Conditions, subject always to applicable law.
